1. Acceptance of Terms

Welcome to PawDream. By accessing and using this service, you agree to comply with and be bound by the following Terms of Use. If you do not agree with any part of these terms, please do not use our service.

These terms constitute a legal agreement between you (the user) and R V SANTOS CONSULTORIA EM TECNOLOGIA DA INFORMACAO LTDA, registered under CNPJ 50.839.014/0001-71, located at Avenida Presidente Getúlio Vargas, 2840, Curitiba-PR, Brazil.

2. Service Description

PawDream is a SaaS platform that allows users to transform photos of their pets into artistic portraits using artificial intelligence. The service includes:

• Upload of pet photos
• Generation of artistic images in various styles
• Credit-based system for service usage
• Download of generated images

3. Registration and User Account

3.1. Registration

To use the service, you must create an account by providing true, accurate, and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials.

3.2. Eligibility

By creating an account, you declare that you are at least 18 years old or have authorization from your legal guardians to use the service.

3.3. Account Responsibility

You are entirely responsible for all activities conducted through your account. Notify us immediately in case of unauthorized use.

4. Credits and Payments

4.1. Credits

The service operates through a credit system. Each image generation consumes a specific amount of credits, as indicated at the time of generation.

4.2. Credit Purchase

Credits can be purchased through payment processed by Stripe. By making a payment, you agree to Stripe's terms of service.

4.3. Validity and Refunds

Purchased credits have no expiration date. We do not offer refunds for credits already purchased, except in cases provided by Brazilian Consumer Protection Law (Law 8.078/90).

4.4. Right of Withdrawal

According to Art. 49 of the Brazilian Consumer Protection Code, you have the right to withdraw from a purchase within 7 days from the date of acquisition, provided the credits have not been used.

5. Acceptable Use

5.1. Appropriate Content

You agree to use the service only for:

• Uploading photos of pets
• Legal and ethical purposes
• Personal or commercial use of generated images

5.2. Prohibitions

It is expressly prohibited to:

• Upload images that violate third-party rights
• Use the service for illegal or fraudulent purposes
• Attempt to bypass or manipulate the credit system
• Reverse engineer or copy the service's technology
• Overload or compromise the system infrastructure
• Resell or redistribute access to the service without authorization

6. Intellectual Property

6.1. Platform Ownership

All content, design, source code, logos, and materials of the PawDream platform are the exclusive property of R V SANTOS CONSULTORIA EM TECNOLOGIA DA INFORMACAO LTDA and are protected by Brazilian intellectual property laws.

6.2. Ownership of Generated Images

The images generated through the service are your property. You have unrestricted usage rights for the created images, including commercial use, provided that the original photos submitted are your property or you have authorization for their use.

6.3. License for Submitted Content

By uploading photos, you grant PawDream a worldwide, non-exclusive, royalty-free license to process, store, and use your images exclusively for the purpose of generating the requested artistic portraits and improving our services.

7. Limitations of Liability

7.1. Service Availability

While we strive to keep the service available, we do not guarantee uninterrupted or error-free operation. We may perform scheduled or emergency maintenance that results in temporary unavailability.

7.2. Image Quality

The quality of generated images depends on various factors, including the quality of the original photo. We do not guarantee specific results but strive to deliver high-quality products.

7.3. Limitation of Damages

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the service.

8. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Significant changes will be notified via email or through the platform. Continued use of the service after modifications constitutes acceptance of the new terms.

9. Cancellation and Suspension

9.1. User Cancellation

You may cancel your account at any time through platform settings or by contacting us. Unused credits will be forfeited after cancellation.

9.2. Suspension by PawDream

We may suspend or terminate your account in case of violation of these terms, fraudulent activities, or misuse of the service.

10. Privacy

The processing of your personal data is governed by our Privacy Policy, which complies with the Brazilian General Data Protection Law (LGPD - Law 13.709/18).

11. Applicable Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The Court of Curitiba-PR is elected to resolve any controversies arising from this agreement, with express waiver of any other, however privileged it may be.
